N august 12, 2007 Garry Newlove, a father of three, was kicked to death outside his home after remonstrating with drunken thugs who were damaging his wife's car. His killer, Adam Swellings, had been released on bail that morning, pending sentence for an assault which had been committed immediately after he had been bailed for a previous assault, committed in violation of a restraining order.

A hideous case, you may feel - but, as the lawyers would say, peculiar to its own facts; a one-off, a freak case. Surely in bailing Swellings the court must have misapplied the law. Surely no lawyer would defend a system where such outcomes were routine. If only.
